Welcome to Presence. These Terms of Service ("Terms") govern your use of the Presence real-time translation service ("Service") operated by Presence ("we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.
1. Description of Service
Presence provides a web-based real-time speech translation service designed for in-person conferences, meetings, and events. The Service allows speakers to speak into a microphone while attendees read translations on their personal devices.
2. Account Registration and Security
To use certain features of the Service, you may need to create channels with associated passwords. You are responsible for:
- Maintaining the confidentiality of your channel passwords
- All activities that occur under your channels
- Notifying us immediately of any unauthorized use
3. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Transmit any harmful, threatening, abusive, or otherwise objectionable content
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the Service or servers
- Use the Service for any illegal or unauthorized purpose
4. Speech Content and Translations
You acknowledge that:
- You are solely responsible for all content spoken through the Service
- Translations are generated automatically by third-party AI services and may not be 100% accurate
- We do not guarantee the accuracy, completeness, or reliability of any translation
- The Service should not be used for legally binding communications where precise language is required
Important: Presence uses Azure Cognitive Services for speech recognition and translation. While we strive for accuracy, machine translation may contain errors. For critical communications, we recommend professional human translators.
5. Subscription and Payment
Some features of the Service require a paid subscription. By subscribing, you agree to:
- Pay all fees associated with your selected plan
- Provide accurate billing information
- Accept that subscriptions auto-renew unless cancelled
Payments are processed securely through our payment provider. We do not store your credit card information.
6. Usage Limits
Your subscription plan determines your usage limits, including:
- Number of channels
- Number of concurrent viewers
- Hours of translation time
Exceeding these limits may result in service interruption or additional charges.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Presence and is protected by international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you speak through the Service. However, you grant us a limited license to process and translate that content for the purpose of providing the Service.
8. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
9. Third-Party Services
Our Service relies on third-party providers, including:
- Azure Cognitive Services for speech recognition and translation
- Payment processors for billing
We are not responsible for the availability or performance of these third-party services.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Presence SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Presence and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
13. Termination
We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which should survive termination shall survive.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the Service after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
